Definition
FAR Part 12 governs the acquisition of commercial products and services — items and services of a type customarily sold or offered to the general public, including minor modifications. When a requirement can be met commercially, agencies are directed to use these streamlined procedures: a tailored clause structure (built around FAR 52.212-1 through 52.212-5), the SF-1449 cover form, and a presumption of price reasonableness based on market pricing rather than detailed cost analysis.
Commercial-item procedures lower the barrier for companies that sell to commercial markets to also sell to the government, and are frequently combined with simplified acquisition procedures at higher dollar ceilings than non-commercial buys.
